FCC Report 12/5: Fines & Waivers Given To Pair Of Late Application Filers

ScarboroughRadio LLC has been fined $3000 and granted a waiver for failing to timely file its longform application for the 92.3 Hugo CO allocation it won in FCC Auction 109. ScarboroughRadio was required to file its full application by September 13, but did not do so until September 30.

The FCC has also granted Christian Broadcasting of Portsmouth’s late filed translator application with a $1000 fine. Christian Broadcasting of Portsmouth won 94.5 Portsmouth VA in the 2018 translator auction, but filed its longform application seven weeks after the July 2, 2018 deadline. A CP will be granted upon payment for the translator, which will rebroadcast Gospel “Peace 1400” WPCE Portsmouth.

After issuing a notice on Thursday that it was terminating the hearing proceeding against 93.3 WQZS Myersdale PA owner Roger Wahl as to whether he is qualified to remain the station’s licensee after being convicted of a felony and multiple misdemeanors, the agency has returned the proceeding to pending status. Administrative Law Judge Jane Halprin erroneously noted that Wahl had failed to submit a written appearance, before revising on Friday that the letter was sent via certified mail on November 11. Wahl pled guilty in July 2020 to charges of trying to solicit male strangers to rape his female friend facilitated through the radio station.

Deletions
Three licenses have been cancelled for failing to timely file their license renewal applications before they expired on December 1. Mountain View Public Broadcasting’s KSFH Mountain View CA, the only station that had licensed to operate on 87.9. Intermountain Public Radio Inc’s 89.9 KZKC Kettleman City CA, and Del Rosario Talpa Inc’s 1090 KNCR Fortuna CA.

High Plains Radio Network’s Classic Rock 102.3 KKYC Clovis NM had its license cancelled after failing to timely resume operations. KKYC went silent on May 30, 2020 stating that a storm caused lightning damage to its transmitter facility. The station did not file a resumption of operations until September 25, 2021 claiming that “After receiving the second round of stimulus loans, we were able to put the station back on the air with staff working from home. Due to new staff and local management changes we failed to file a timely resumption with the commission. The delay was only due to the results of the Covid-19 impact.”
