FCC Report 1/9: Yet Another Fort Myers AM Surrenders Its License

Sun Broadcasting has turned in the license of 1240 WFSX Fort Myers FL. WFSX had been feeding Regional Mexican “La Raza 94.1” W231DC Fort Myers. WFSX is the fourth Fort Myers area AM to turn in its license in the past seven months following Sun’s 1270 WNOG Naples and Fort Myers Broadcasting’s 1200 WAXA Pine Island Center and 1460 WNPL Golden Gate in May 2021. W231DC is now being fed by 93.7 WHEL-HD2 Sanibel.

FCC Actions

The FCC has rejected Schwab Multimedia’s Application For Review over the denial of tolling their CP for 1500 KWIF Culver City CA. Originally applied for in 2004, KWIF was granted a CP in November 2016 set to expire if not built by November 2, 2019. After a challenge to the original CP grant, the CP was tolled with the construction deadline extended to April 13, 2020 and again to October 30, 2020 due to COVID related restrictions in place. A third extension request was denied as the FCC found no connection between Schwab’s request based on the ongoing effects of COVID and the wildfires effecting California at the time as Culver City was not in an area evacuated or burned and since radio stations were deemed essential services they were not prevented from building the station.

On October 26, 2020 a Petition For Reconsideration and application to move to a new site were filed noting that Schwab had lost permission to build at the former site before the March tolling request, which the FCC noted that was procedurally barred since it could have been presented earlier. Schwab had stated that the loss was due to Cumulus applying to move 790 KABC Los Angeles to that site which was applied for in 2017 and licensed in February 2018, well before the tolling requests were made. The FCC has denied the Application For Review on the grounds that Schwab failed to demonstrate that it undertook any construction efforts that were thwarted by COVID and that it does not grant tolling for site-related difficulties because the choice of sites is a permittee’s independent business decision within its control.
